Chapter 7

Chapter 7 bankruptcies offer quick and simple relief to those who qualify.

In fact, the whole process generally takes as little as 3 months and commonly requires only one trip to the courthouse.

A Chapter 7 bankruptcy may allow you to keep your home, automobile, household furnishings, and other basic items as “exempt property.” To qualify for Chapter 7 protection, however, your household income cannot be above certain levels that we can explain. Our Chapter 7 fees range from $250-$700.

Under Chapter 7, you ask the court to discharge your debts completely. Chapter 7 is often used to eliminate credit card debt, unpaid bills, and medical bills. However certain debt – like most student loans – cannot be discharged. In addition, if you have property that is not exempt, it may be sold and the proceeds distributed to creditors by the court. If you are substantially behind on your mortgage or car payments and want to keep those properties, Chapter 7 filing may not be a good choice for you.

Our Chapter 7 fees are based on the number of creditors to whom you are in debt:

1 - 2 Creditors $250
3 - 5 Creditors $400
6 - 8 Creditors $500
8+ Creditors $600

Chapter 13

Debtors with incomes too high to qualify for Chapter 7 are often required to file Chapter 13 bankruptcies. Chapter 13 bankruptcies gives debtors an opportunity to repay some or all their debts at lower or no interest over three to five years. Typically, you are allowed to keep your home and car.
